Jane A. Rheinheimer’s Practice Areas

Jane Rheinheimer has been practicing law in San Diego since 1987 and is the principal of Rheinheimer + Smigliani, APC. She received her undergraduate degree in languages and linguistics from Georgetown University and her law degree from the University of San Diego.

Approximately half of Jane’s practice focuses on the defense of employment and ADA litigation for a number of industries including large automobile dealerships, contractors, retailers and service providers. Jane also represents and counsels a number of large nonprofit organizations regarding employment, wage and hour and union issues.

The remainder of the Jane’s practice focuses on professional liability defense emphasizing the defense of California Realtors®. Other professions represented include escrow officers, design professionals, property inspection companies, accountants and insurance brokers.

Jane has served as a member of the California Association of Realtors® exclusive Strategic Defense Panel since its inception in 2005 and also currently serves as a member of the San Diego Association of Realtors® Risk Management Committee. For the past decade she has taught a graduate-degree course in legal issues, human resources, and risk management at the University of San Diego’s prestigious Institute for Nonprofit Education and Research.

Jane has been awarded Martindale-Hubbell’s highest possible rating, AV Preeminent 5.0 out of 5, continuously since 1997. She has been named as one of San Diego’s Top Lawyers by San Diego Magazine for a number of years and is listed to California Super Lawyers.

Jane is married with three adult daughters, a dog, and two obnoxiously fluffy cats. She volunteers as a Court-Appointed Special Advocate (CASA) for youth in foster care. Jane also enjoys cooking, road trips, making jewelry and anything that allows her to spend time underwater.

Professional Liability Defense
San Diego County Superior Court: defense verdict following ten-day jury trial in which plaintiffs asked jury to award damages in excess of $1 million.

Professional Liability Defense
JAMS San Diego, binding arbitration. Represented dual agent real estate brokers. Arbitrator awarded our clients contractual indemnity against codefendant developer/sellers for plaintiffs’ damages. Recovered attorneys’ fees from developer under terms of listing agreement. Our motion for costs and fees granted as against plaintiffs for their failure to beat our statutory offer of compromise.

Professional Liability Defense
Ventura County Superior Court: 7-day jury trial. Represented broker on respondent superior defense involving “rogue” agent. Defense verdict for broker. Our motion for costs granted against plaintiff.

Professional Liability Defense
Riverside County Superior Court: Trial court granted pretrial motion disposing of case in its entirety due to plaintiffs’ failure to designate proper experts. Plaintiffs appealed. Court of Appeal affirmed trial court ruling, case dismissed, judgment for costs in favor of our clients.
