Suzanne L. Smigliani’s Practice Areas

Suzanne Smigliani received her BA from UCLA and her JD from USD. She was admitted to the State Bar of California in 1994 and has worked with Rheinheimer + Smigliani, APC or its predecessor firm since 1996.

Suzanne’s practice has long focused on the defense of real estate licensees in nondisclosure litigation. She cut her teeth on construction defect litigation so she knows how things are built and she knows what’s a big deal and what’s not. She is an active member of CAR’s Legal Affairs Forum and has successfully represented hundreds of California real estate brokers and agents.

Suzanne also specifically works on the defense of business owners in workplace-related litigation including discrimination, harassment, wrongful/constructive termination, and wage and hour issues. Her clients range from corporations with hundreds of employees to family-owned small businesses. Whether big or small, all clients receive Suzanne’s full attention and tenacious advocacy in support of their rights.

Suzanne was awarded Martindale Hubbell’s highest AV 5.0 out of 5 rating for legal ability and ethics. She has also been repeatedly named one of San Diego’s Top Lawyers for professional excellence and ethical standards by San Diego Magazine.

Suzanne is married and has a son and a daughter in high school, both of whom play ice hockey and lacrosse. She is a big supporter of youth sports and weekends often find her at rinks throughout Southern California. Suzanne is also a member of Team Smig for MS, one of the MS Society’s biggest advocates and leading fundraisers.

Real Estate Errors & Omissions
Defense verdict in favor of clients following four week trial at which plaintiffs were seeking one-half million dollars in damages for alleged fraud, misrepresentation, and failure to disclose mold and other material defects in the sale of real estate; in post trial motions clients were awarded $40,000 in costs.

Real Estate Errors & Omissions
Defense verdict following arbitration in favor of clients who were developers and sellers of new homes in Indian Wells. Plaintiffs sought rescission and damages for alleged fraud and failure to disclose material facts in the sale of properties to multiple homebuyers. In addition to being cleared of all claims against them, clients were awarded costs incurred during the litigation and arbitration.

Defense verdict in favor of realtor clients following a five week arbitration at which plaintiffs were seeking rescission of their purchase of a 3.3 million dollar home and damages for alleged fraud and failure to disclose construction defects; in addition to the finding in their favor on all claims, clients were awarded both costs and attorneys fees incurred during the litigation and arbitration.
